Rules and Regulations of Deer Creek Golf & Tennis RV Resort,

Phase Three-A

Homeowners Association, Inc.

A Florida Not for Profit Corporation

 

Pursuant to Florida State Laws and the By-Laws of Deer Creek Golf & Tennis RV Resort Phase Three-A (AKA Osprey Point), these Rules and Regulations shall be used to govern the use and occupancy of Osprey Point. These Rules and Regulations are to enhance the Declaration of Restrictions and Covenants and not to replace them.

 

Section 1: General 

 

a) The provisions of these rules are deemed severable and independent of each other to the extent that if any one or more clauses should be invalid or unenforceable for any reason, the validity and enforceability of other provisions of these Rules and Regulations shall not be affected.

 

b) Yearly assessments are due on or before April 1 of each year.

 

c) Payment of yearly assessments and all other fees are payable in US Currency.

 

Section II: Miscellaneous

 

a)     In keeping with the theme of the park, noxious or offensive behavior by residents, renters or invitees that becomes an annoyance or nuisance to other unit owners or occupants is not permitted.

 

b)    Quiet hours are from 10:00 p.m. to 8:00 a.m.

 

c)     No firearms of any type are to be discharged within the Park boundaries for sport.

 

d)    State Law prohibits approaching or feeding of alligators. Feeding of wild animals and birds is discouraged. Destruction, trapping or harming of wildlife within the Park is prohibited unless authorized by the Manager.

 

e)     Each resident is responsible for the control of insects, mice, and other vermin on their property.

 

Section III: Facilities

 

a)     All Park Buildings are designated as non-smoking facilities.

 

b)    The park Facilities are available only to residents, renters and their guests.

 

c)     The use of the recreation hall for non-residents committee sponsored events shall be permitted only after obtaining the approval of the Residents Committee. To reserve the club house contact the chairperson with name date, time, phone number, number of expected guests and Osprey Point address. After permission is granted, enter the date, time and phone number on the calendar in the club house.

 

d)    Private users of the clubhouse must bring their own supplies, including paper towels, soap, coffee, electrical appliances, and other disposable products. After the event the users are responsible for cleanup of all appliances, tables, floors, etc. and must deposit their trash in the dumpsters located behind the main clubhouse.

 

e)     Pools are open until dusk. Use of the pool is governed by the Pool Regulations posted at the pool. The pool has no lifeguard. Anyone using the pool does so at their own risk! Please do not swim alone

 

f)     Persons in wet bathing attire may not enter the main recreation hall. However, dry suits with cover-ups and foot wear are allowed.

 

g)     The coin operated laundry located in the clubhouse building is for the use of residents, renters, and their guests. Persons using the laundry equipment are to leave machines and dryer filters clean and suitable for the next user.

 

h)    All buildings, equipment and facilities are used at your own risk. The Corporation is not responsible for the personal property of others.

 

i)      No person under the age of eighteen is permitted in the clubhouse or pool unless accompanied by an adult.

 

j)      Lot owners are liable for any damages to Park property caused or contributed to by their guests.

 

Section IV: Speed Limits, Parking and Safety

 

a)     The speed limit for all vehicles in the park is 10 miles per hour. This means that a standard 40’ wide lot should take approximately 2.7 seconds to pass.

 

b)    Vehicles shall not be parked on the streets overnight.

 

c)     The use of lights on vehicles including bicycles and golf carts is required after dark. Walkers should carry a flashlight while walking at night.

 

Section V: Pets

 

a)     All pets permitted under the Restrictions and Covenants must possess current licenses when so required by law. Dogs and cats must be inoculated for rabies.

 

b)    All dogs and cats must be leashed when off their lots. Any pet found in the Park without a leash will be picked up by Animal Control.

c)     Pets may not frequent other homeowner’s lots without the homeowner’s permission. Persons walking pets must not allow their animals to trespass on other resident’s property.

 

d)    Dog owners must remove and properly dispose of dog excrement by placing it in a bag or other suitable container.

 

e)     Pets with the exception of service animals are not permitted in the Park Office, Pool Area, Clubhouse, Kitchen or Laundry Room.

 

Section VI: Rental of Lots and/or Homes

 

a)     Lot owners are responsible to present prospective renters with a copy of these Rules and Regulations, along with the Restrictions and Covenants and obtaining written concurrence from the renter that they are aware of and will comply with all such rules and regulations.

 

b)    Failure to comply with the Rules and Regulations and/or Restrictions and Covenants may result in termination of the rental agreement. It will be the owners’ responsibility to evict the non conforming renters if continual non-compliant behavior is exhibited.

 

These Rules and Regulations of Osprey Point are approved on the ­­­31st  day of January, 2008 by the Lawfully Elected Board or Directors in compliance with Article VII of the corporate By-Laws.
